Doe v Warner Bros Case for Plaintiff by Richard Rydstrom; Second Appellate District, Los Angeles: The law protects California employees and workers from discrimination in many forms including DISABILITY DISCRIMINATION. Many years ago, I overturned a dismissal of a case against Warner Bros and others for Handicap Discrimination for a floating secretarial worker who had a nervous-tick in her neck, and was ridiculed by a movie producer (on Rojo v Klinger arguments). Employers are prohibited from discrimination for many reasons including Handicap Discrimination, Medical Condition Discrimination, etc. California Government Code Section 12900 is known as the "California Fair Employment and Housing Act."
Americans with Disabilities Act (ADA) and the Rehabilitation Act (RA): However, both federal and state laws may provide protection; for example, the federal Americans with Disabilities Act (ADA) and the Rehabilitation Act. The Americans with Disabilities Act (also known as ADA) prohibits discrimination by employers with 15 or more employees (after July 26, 1994). The 2008 Amendment is called the ADA Amendments Act of 2008 (ADAAA). The definition of “disabled” was broadened in the ADAAA to include perceived disability rather than whether you are” disabled.”
You cannot be discriminated upon prior to employment (refused employment or an interview) or during employment (lack of promotions, de-motions, or limiting the work duties or benefits); or refusing to provide reasonable accommodations for a disabled employee (or potential employee). You are afforded protections for hiring or firing. By law, employers must make “reasonable accommodation” for employees who qualify under the American with Disabilities Act.
The Rehabilitation Act of 1973 prohibits discrimination in Federal employment, programs run by Federal agencies, programs that are subsidized by the Federal government and by Federal contractors. The same ADA standards are incorporated into the RA
